Please read these Terms of Service ("Terms") carefully before using the Jyotish baje mobile application (the "App") operated by Sodhera ("we," "us," or "our").

By downloading, installing, accessing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

1. Acceptance of Terms

By creating an account, accessing, or using the App, you confirm that:

  1. You have read, understood, and agree to be bound by these Terms and our Privacy Policy.
  2. You are at least 13 years of age (or the minimum age required in your jurisdiction to consent to using the App).
  3. If you are under the age of majority in your jurisdiction, you have obtained consent from a parent or legal guardian.
  4. You have the legal capacity to enter into a binding agreement.

2. Description of the Service

Jyotish baje is a Vedic astrology application that provides:

  • Kundali (Birth Chart) Generation: Computation of Vedic birth charts using sidereal planetary positions with Lahiri ayanamsa.
  • Rashifal (Horoscope): Daily, weekly, monthly, and yearly horoscope readings based on your birth chart.
  • Panchanga: Traditional Vedic almanac information including tithi, yoga, karana, and nakshatra.
  • Bikram Sambat Calendar (Patro): A Nepali calendar with cultural and religious events.
  • Family Astrology (Parivar): Ability to add family members and generate astrological readings for the entire family.
  • AI Chatbot ("Pandit-ji"): An artificial intelligence-powered conversational assistant that answers questions about Vedic astrology, vastu, gemstones, colors, and related topics.
  • Voice Input: Optional voice-to-text input using on-device speech recognition.
  • Bilingual Support: Full support for English and Nepali (Devanagari).

3. Important Disclaimers About Astrological Content

THIS IS THE MOST IMPORTANT SECTION OF THESE TERMS. PLEASE READ IT CAREFULLY.

3.1 Astrology Is Not Professional Advice

All astrological content, readings, predictions, interpretations, recommendations, and guidance provided by Jyotish baje — whether generated by on-device algorithms or by the AI-powered Pandit-ji — are offered for informational, cultural, spiritual, and entertainment purposes only.

Jyotish baje's content does not constitute and must not be relied upon as:

  • Medical advice — Do not use astrological readings as a substitute for professional medical diagnosis, treatment, or advice. Always consult qualified healthcare professionals for health concerns.
  • Legal advice — Do not rely on astrological content for legal decisions. Consult a qualified attorney for legal matters.
  • Financial or investment advice — Do not make financial decisions based on horoscope readings or astrological predictions. Consult a qualified financial advisor.
  • Psychological or mental health counseling — Astrological guidance is not a substitute for professional mental health services. If you are experiencing mental health difficulties, please contact a qualified professional.
  • Any other form of professional advice — Jyotish baje does not replace the judgment of qualified professionals in any field.
⚠️ If you are in crisis or experiencing emotional distress: Please contact your local emergency services immediately. In Nepal, call the Nepal Police emergency line at 100 or the mental health helpline at 1166. In the United States, contact the Suicide & Crisis Lifeline at 988. Jyotish baje is not equipped to provide emergency assistance of any kind.

3.2 No Guarantee of Accuracy

While we strive to implement authentic Vedic astronomical algorithms (using sidereal positions and Lahiri ayanamsa), we make no representations or warranties regarding:

  • The accuracy, completeness, reliability, or suitability of any astrological calculation, reading, or prediction
  • The correctness of AI-generated responses from Pandit-ji
  • The fulfillment or outcome of any prediction or recommendation
  • The alignment of our computations with those of any specific astrologer, school, or tradition

Astrological computations involve complex astronomical data, multiple schools of interpretation, and inherently subjective elements. Results may vary from those produced by other software or human astrologers.

3.3 AI-Generated Content

Pandit-ji's responses are generated by artificial intelligence (currently powered by OpenAI). AI-generated content:

  • May contain errors, inaccuracies, or hallucinations
  • Should not be treated as authoritative or definitive
  • Does not represent the views or endorsements of Sodhera
  • Is generated based on the data you provide and may reflect biases in the underlying AI model
  • Is not a substitute for consultation with a qualified Vedic astrologer or pandit

3.4 Your Responsibility

You acknowledge and agree that:

  • Any reliance you place on the App's content is strictly at your own risk
  • You are solely responsible for any decisions you make based on the App's content
  • We shall not be liable for any consequences arising from your reliance on astrological readings or AI-generated guidance

4. User Accounts

4.1 Account Creation

When you first use the App, an anonymous account is created for you automatically. You do not need to provide an email address, phone number, or password.

4.2 Account Security

You are responsible for:

  • Maintaining the security of your device and the App
  • All activities that occur under your account
  • Notifying us promptly of any unauthorized use of your account

4.3 Account Termination by You

You may terminate your account at any time by signing out of the App (which erases all local data) and requesting deletion of cloud data by contacting us at privacy@sodhera.com.

4.4 Account Termination by Us

We reserve the right to suspend or terminate your account at our sole discretion, without prior notice, if:

  • You violate these Terms
  • Your use of the App poses a security risk or may cause harm to us or other users
  • We are required to do so by law

5. User Content

5.1 Your Data

You retain ownership of all personal data you enter into the App, including names, birth details, family member information, chat messages, and calendar events ("User Content").

5.2 License to Us

By using the App, you grant us a limited, non-exclusive, worldwide, royalty-free license to use, process, store, and transmit your User Content solely for the purpose of providing, maintaining, and improving the Jyotish baje service. This includes transmitting relevant portions of your data to our server-side backend and third-party service providers (as described in our Privacy Policy) to generate AI-powered responses.

5.3 Content Guidelines

You agree not to input, upload, or transmit through the App any content that:

  • Is unlawful, threatening, abusive, harassing, defamatory, or invasive of another's privacy
  • Infringes any intellectual property rights
  • Contains malware, viruses, or other harmful code
  • Attempts to exploit, harm, or inappropriately interact with the AI system
  • Violates any applicable law or regulation

5.4 No Obligation to Monitor

We are not obligated to monitor User Content but reserve the right to review and remove any content that violates these Terms.

6. Intellectual Property

6.1 Our Intellectual Property

The App, including its design, code, algorithms, graphics, icons, ornamental elements, astrological computation engines, text content, user interface, and overall look and feel, is owned by Sodhera and is protected by copyright, trademark, and other intellectual property laws.

The "Jyotish baje" name, "ज्योतिष बाजे" name, and associated branding are trademarks of Sodhera.

6.2 License to You

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on your personal iOS device(s) for personal, non-commercial use.

6.3 Restrictions

You agree not to:

  • Copy, modify, distribute, sell, lease, sublicense, or create derivative works of the App or any part thereof
  • Reverse engineer, decompile, disassemble, or attempt to extract the source code of the App
  • Remove, alter, or obscure any copyright, trademark, or other proprietary notices
  • Use the App for any commercial purpose without our prior written consent
  • Use automated means (bots, scrapers, etc.) to access or interact with the App
  • Circumvent or attempt to circumvent any security measures or access controls
  • Reproduce or redistribute the astrological algorithms, computation engines, or interpretation databases

7. Third-Party Services

7.1 Service Providers

The App uses the following third-party services to provide its functionality:

7.3 No Endorsement

References to temples, cultural sites, or other external entities within the App do not constitute endorsement by or affiliation with those entities.

8. Availability and Modifications

8.1 Service Availability

We strive to keep the App available at all times, but we do not guarantee uninterrupted or error-free operation. The App may be temporarily unavailable due to:

  • Maintenance (scheduled or emergency)
  • Server or infrastructure outages
  • Network connectivity issues
  • Force majeure events

8.2 Modifications

We reserve the right to modify, update, suspend, or discontinue the App (or any part thereof) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation.

8.3 AI Model Changes

The AI model powering Pandit-ji may be updated, changed, or replaced at any time. Such changes may affect the nature, quality, or style of AI-generated responses. We do not guarantee consistency of AI outputs across versions.

9. Fees and Payments

Jyotish baje is currently offered free of charge with no in-app purchases or subscriptions. We reserve the right to introduce paid features in the future. If we do, we will provide advance notice and any paid features will be clearly identified before purchase.

10. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

THE APP AND ALL CONTENT, FEATURES, ASTROLOGICAL COMPUTATIONS, AI-GENERATED RESPONSES, AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

WE EXPRESSLY DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

  • IMPLIED WARRANTIES of merchantability, fitness for a particular purpose, and non-infringement
  • WARRANTIES OF ACCURACY regarding astrological calculations, predictions, or AI-generated content
  • WARRANTIES OF RELIABILITY regarding the availability or performance of the App or its backend services
  • WARRANTIES OF SECURITY regarding the absolute safety of your data (though we take reasonable precautions)

NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED FROM THE APP OR FROM US SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

11.1 Exclusion of Damages

IN NO EVENT SHALL SODHERA, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION:

  • Loss of profits, revenue, data, or goodwill
  • Personal injury or emotional distress
  • Damages arising from reliance on astrological content or AI-generated advice
  • Damages arising from unauthorized access to or alteration of your data
  • Damages arising from any third-party service failure
  • Any other intangible losses

WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

11.2 Cap on Liability

OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE APP SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED US DOLLARS (USD $100).

11.3 Exceptions

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the fullest extent permitted by law.

12. Indemnification

You agree to defend, indemnify, and hold harmless Sodhera, its directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from:

  1. Your use of the App
  2. Your violation of these Terms
  3. Your violation of any third-party rights
  4. Any content you submit through the App
  5. Any decision or action you take based on the App's astrological content or AI-generated responses

13. Governing Law and Dispute Resolution

13.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Nepal, without regard to conflict of law provisions.

13.2 Dispute Resolution

Any dispute, controversy, or claim arising out of or relating to these Terms or the App shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved through negotiation within thirty (30) days, it shall be submitted to the exclusive jurisdiction of the courts of Kathmandu, Nepal.

13.3 Waiver of Class Action

To the extent permitted by applicable law, you agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

14. General Provisions

14.1 Entire Agreement

These Terms, together with the Privacy Policy and the End-User License Agreement (EULA), constitute the entire agreement between you and Sodhera regarding the App and supersede all prior agreements and understandings.

14.2 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, severed from these Terms. The remaining provisions shall continue in full force and effect.

14.3 Waiver

Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision. Any waiver must be in writing and signed by us.

14.4 Assignment

You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign these Terms without restriction.

14.5 Force Majeure

We shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to natural disasters, acts of government, internet service disruptions, power failures, or third-party service outages.

14.6 Headings

Section headings are for convenience only and do not affect the interpretation of these Terms.

15. Changes to These Terms

We may revise these Terms at any time by posting the updated version within the App or on our website. Material changes will be communicated through the App. The "Last Updated" date at the top indicates when the Terms were last revised.

Your continued use of the App after revised Terms become effective constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the App.

17. Apple-Specific Terms

These Terms are entered into between you and Sodhera, not with Apple Inc. ("Apple"). Sodhera, not Apple, is solely responsible for the App and its content.

17.1 Scope of License

The license granted to you is limited to a non-transferable license to use the App on any Apple-branded device that you own or control, as permitted by the Usage Rules set forth in the Apple Media Services Terms of Service.

17.2 Maintenance and Support

Sodhera is solely responsible for providing maintenance and support services for the App. Apple has no obligation whatsoever to furnish any maintenance or support services.

17.3 Warranty

In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App.

17.4 Product Claims

Sodhera, not Apple, is responsible for addressing any claims relating to the App, including but not limited to: (a) product liability claims; (b) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (c) claims arising under consumer protection or similar legislation.

17.5 Intellectual Property Claims

In the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, Sodhera, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.

17.6 Third-Party Beneficiary

Apple and Apple's subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.

17.7 Legal Compliance

You represent and warrant that: (a) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (b) you are not listed on any U.S. Government list of prohibited or restricted parties.
